1. Overview
At Madaliya Associates, we strive to provide the highest quality legal services. This Refunds & Cancellations Policy outlines the terms under which refunds may be issued and how cancellations are handled.
2. Service Fees
Our service fees consist of two components:
- Professional Fees: Fees charged by Madaliya Associates for our legal expertise and services.
- Government Fees: Official fees paid to government authorities (Trademark Office, Patent Office, ROC, etc.) on your behalf.
3. Refund Policy
Before Work Commencement
If you cancel your service request before we have commenced work on your application, you are eligible for a full refund of professional fees. Government fees already paid are non-refundable.
After Work Commencement
Once work has commenced (trademark search conducted, application prepared, or filed), professional fees are non-refundable. Government fees paid to authorities are non-refundable under any circumstances.
Application Rejection
If your application is rejected by the relevant authority due to reasons beyond our control (prior conflicting marks, examiner discretion, etc.), professional fees are non-refundable. We will, however, advise you on the best course of action.
Service Failure
If we fail to deliver the agreed service due to our error or negligence, we will either rectify the issue at no additional cost or provide a partial/full refund at our discretion.
4. Cancellation Process
To cancel a service, please:
- Contact us via email at support@madaliya.com
- Include your name, contact details, and the service you wish to cancel
- State the reason for cancellation
- Our team will respond within 2 business days with confirmation and refund details (if applicable)
5. Refund Processing
Approved refunds will be processed within 7-10 business days. Refunds will be issued through the same payment method used for the original transaction. We are not responsible for delays caused by banks or payment processors.
6. Non-Refundable Items
The following are non-refundable under all circumstances:
- Government filing fees paid to trademark, patent, or company registration offices
- Fees for services already rendered (trademark searches, document preparation)
- Fees for applications already filed with government authorities
- Out-of-pocket expenses incurred on your behalf
7. Disputes
If you have a dispute regarding our refund policy, please contact us directly. We are committed to resolving disputes amicably. If a resolution cannot be reached, disputes shall be subject to the jurisdiction of courts in Surat, Gujarat, India.
